Bonita Bay Group, developer of the 2,400 acre master planned community Bonita Bay, has sued the community’s master homeowners association over the use of the words “Bonita Bay”. The developer claims in the suit that the Bonita Bay Community Association failed to enter into a licensing agreement for use of the company’s trademarks.

Struggling financially after the housing slump started, the developer sold Bonita Bay’s golf club to the homeowners association for $11.5 million dollars in March 2011. Bonita Bay Group claims the homeowners association agreed at the time of the sale to enter into a licensing agreement for use of the company’s trademark.

Bonita Bay Group is asking the court for damages and an injunction preventing the association from using the words “Bonita Bay” and related trademarks.
